How do I retain custody?
I'm in Illinois. About a month ago my wife left with my 15 month old son and took an order of protection on me. She went to her friend's apartment in a neighboring town. They do drugs and have left the children asleep and gone to the bar. We went to a plenary hearing and I basically said I would agree to not contest with continuing the op, but I got visitation, my house, and I said I wanted a divorce. After this she did not show up at the place of exchange (police dept). I filed a report. The officer told me she was removed from that apartment and went back to her parents. They didn't want her so she went to a shelter. The shelter called dcfs. She went to the psych ward for two weeks and I received temporary custody. Now she's out and back where she was before. She's calling me almost every day. I'm trying to ignore her and find a ruthless lawyer. The baby has a full-time babysitter and a good schedule and is doing well. I'm thinking dcfs is done with this, so now someone has to go to court. The order is still in effect so I can't see my wife to drop him off with her even if I wanted to. She's running with a bad crowd. She has no job or money. I don't know what the doctors said about her. She has two other children she doesn't have custody of as well. Can I get the order dropped because she was in the psych ward? As long as that order continues nothing has to change. How can I keep my son from a bad mother?
